Becoming a tenant is a step by which millions of Moroccans go through every year. But for the rental to become a reality, a lease agreement needs to be signed with the owner. A lot of people, blinded by finding a place, tend to overlook this step! They sign the contract without thoroughly checking it…which can lead to some unwanted surprises!
To avoid getting scammed it’s important to know what a lease agreement contains and to make sure everything is within the law.
Let’s start by defining what a lease agreement is:
A lease agreement is a contract in which the “landlord” gives the “tenant” the right to use his property for a certain period for a monthly rent.
This contract must be done in writing and needs to contain the following:
First and last names of the landlord and tenant,
The occupation of the landlord and tenant,
The address of the landlord and tenant,
The I.D of the landlord and tenant,
All the information related to the estate agency, if applicable,
Definition of the locals to be rented
The use of the premises
The rent amount and the frequency of payment
The rental charges
The terms of payment
The obligations of each party
High attention needs to be paid to the obligations the contract puts on each party, as well as to the content of certain clauses mainly:
The items that remain under the responsibility of the landlord
The deposit amount
The termination notice
